Custom mills require a Certificate of Designa- <br />tion under the SWDFA, and do not need a Mined Land Reclamation <br />Board permiC. Even iE the mill takes waste Erom only a single <br />off-site source, the mill requires a Cb. If a mill ceasos taking <br />off-site wastes. the mill may continue operations under the CD, <br />or may, at its option, apply for a Mined Land permik, and abandon <br />the CD. CDH intends to define "custom mill" by regulation. <br />3. Heap Leaching Operation. Facilities conducting heap leaching <br />do not require a CD, but simply a Mined Land permit. Mined Land <br />in ;its permit process will ensure that the substantive standards <br />of the SWDFA are complied with in the disposal of the heap leach- <br />ing waste on-site. Such disposal is the disposal oP one's own <br />waste on one's own property, and does not require a CD, but does <br />require compliance with the substantive standards of the SWDFA, <br />If a facility heap leaches materials which were imported Erom <br />off-site, and the other site has a Mined Land permit, the <br />facility's heap teaching is simply the processing of purchased <br />raw material. Accordingly, no Certificate of Designation is <br />required. <br />Q. Mined Land permitted areas used as landfills after mining is <br />completed. If the landfill receives only waste from the mined <br />facility, no CD is required, since the filling is the disposal of <br />one's own waste on one`s own property.
