The request was deemed
complete by this Division on September 2, 1997. The release request is for a Phase I bond release for
the loadout portion of the permit area. The release request is for up to 60% of the total performance
bond held for the loadout area, since EFCI has backfilled, regraded, and reestablished drainages in the
area. EFCI has requested the release of $27,000.00 of the applicable $45,000.00 bond. The surface
ownership is private, and the coal mined was private.
We will contact you to advise you of the Division's required bond release inspection of the site as soon
as it has been scheduled. A proposed decision on the application will be issued within sixty (601 days
of our inspection.
If you have questions or aze in need of additional information, please contact me.
Sincerely,
I.C~~
Susan L.
