This revision <br />is requested to clarify that Oxbow Carbon & Minerals, Inc. has no maintenance and reclamation <br />liability for the section of abandoned State highway from the point that the road from the Sanborn <br />Creek Mine portal intersects the old highway and east along the old highway to the point where <br />state maintenance ends. It is Oxbow Carbon & Minerals, Inc.'s understanding that the State of <br />Colorado has rights for this highway right of way through a prescriptive easement and should <br />therefore be responsible for the maintenance and reclamation of its highway. <br />This minor revision clarification affects Rule 2.05.3(3)(c): Operation Plan, Page 2.05-13vii. <br />Please feel free to contact the undersigned at the above address if you have any questions or need <br />additional information regarding this request.
