<br />• Mr. Hoza has indicated a concern over the scheduling and sequence of reclamation for the <br />original site as wetl as the amended area. In the response to the Division's adequacy concerns <br />on page 6 above, under Exhibit E -Reclamation Plan, item 2, United has provided a detailed <br />reclamation schedule that will address this concern. <br />• Mr. Hoza has pointed out that there is not enough topsoil to reclaim the original permitted <br />area. He is correct in this azgument. However, in the response to the Division's adequacy <br />concerns, this issue is thoroughly explained in Exhibit D- Mining Plan, item 3. <br />3. Sky Walters -Norwood, Colorado (March 22, 1996) <br />• Much of Mr. Walters' concerns are with issues that aze typically within the realm of local <br />agencies. He has posed the question of compliance with Montrose County Zoning Regulations. <br />With regard to Section IV.8.b.(5) of the Montrose County Zoning Resolution (October 13, <br />1994), the "mining of sand and gravel or other minerals existing at the time of adoption of <br />Zoning Amendment No. 20-94 (October 13, 1994) or subsequent expansion of existing <br />operations within property boundaries" is allowed as a use-by right. United has a letter from <br />Richazd Gibbons, County Planner, to that effect. This letter was submitted in the original <br />application package in Exhibit M. <br />• He also has questioned the use of water out of the Farmer's Water Development Ditch. The <br />same answer as has been given to other objectors has been given to him. <br />• Mr. Walters has expressed a desire for the State to regulate the days and hours of operation, <br />although this is a local issue. It should be known that when United began crushing gravel this <br />summer, the crews started working at 6:00 a.m. When it became known to United that such <br />an early start time was objectionable to some of the neighbors, the starting time for the crusher <br />crew was changed to 7:00 a.m., which seemed to be acceptable. This should demonstrate the <br />ability to communicate and accommodate when issues aze reasonably presented. <br />• Mr. Walters was invited to and attended a courtesy visit at the site just recently. Also attending <br />was Ms. Abbey Altshuler and Mr. Mel Staats, a Montrose County Commissioner. <br />4. Mary Ann Gaston - Norwooa! Colorado (April 8, 1996) <br />• Ms. Gaston has stated that as of the date of her letter, an application for an air emissions permit <br />had not been submitted. The application was submitted on February 6, 1996, and Initial <br />Approval was issued on April 24, 1996. <br />• She has also stated that San Miguel county was•notified of the application. A full copy of the <br />application package was filed with the San Miguel County and Montrose County Clerks and <br />Recorders on February 20, 1996. <br />12 <br />
