UNITED COMPANIES <br />UNITED/NORWOOD GRAVEL PIT <br />FILE NO. M-88-037 <br />AMENDMENT NO. 001 <br />RESPONSE TO OBJECTORS' LETTERS <br />United Companies has been instructed to review the letters of objection that have been received by the <br />Division of Ivfinerals and Geology regarding the above referenced application to amend, and to respond <br />to those issues that are within the authority of the Division. <br />Charles J. Heldman - Norwood, Colorado (March !S, 1996) <br />Most of Mr. Heldman's concerns are related to local zoning issues, such as traffic and visual <br />impacts. He is also concerned over possible air pollution. United's position on this item is that <br />the Reclamation Plan, and the dust control plan of the air emissions permit with the State of <br />Colorado are adequate to mitigate air pollution problems when observed and properly <br />administered. <br />2. Tony Hoza -Norwood, Colorado (March !9, 1996 and Ju~re, 1996). <br />Mr. Hoza has expressed several concerns that are within the realm of the local governments. <br />The issues that are within the authority of the Division of Minerals and Geology are addressed <br />as follows. <br />The conversion of the operation from a 110 Permit to a 112 Permit has been questioned as far <br />as the legality if the process that was used is concerned. United is operating under the premise <br />that the permit is valid as has been properly managed throughout the years. <br />Mr. Hoza pointed out that the property owners on the west side of 44ZN Road, within 200 feet <br />of the affected lands were not properly notified in the initial notification procedure. This was <br />due to a misunderstanding of the "adjacent" criteria, since the county road eliminated those <br />properties from adjacency. The revised Construction Materials Rules and Regulations now <br />includes all properties within 200 feet of the boundary of the affected land. United corrected <br />this oversight on May 16, 1996 with proper notification to the property owners on the west <br />side of 44ZN Road within 200 feet of the boundary of the affected land. Certification of this <br />notice was supplied to the Division. <br />The intent of the applicant, originally, was to use water out of the Farmer's Water <br />Development Ditch for production water and dust suppression. Further inquiries revealed that <br />the water rights that were to be utilized were not to be used in such a manner, unless the water <br />was tail-water (waste water) from agricultural use. United elected to not participate in this <br />questionable use of the water. United is instead pursuing a well permit, and the lease or <br />purchase of industrial water rights. <br />
