The <br />Division of Minerals and Geology has already mandated that a gated valve be instal led in the <br />final sediment pond that may discharge stormflows in a Easternly direction that will flow into <br />Sand Gulch drainage which drains into the Arkansas River approximately one mile ".o the South. <br />Tezak Heavy Equipment Company, Inc. requests that the Division of Water Quality review <br />and comment on the information submitted and advise the operator as to the correct procedure to <br />follow in amending the existing stormwater discharge permit accordingly. The operator also <br />requests the Division's determination if a NPDES permit is appropriate in this situation. Please <br />respond in writing as soon you have had a chance to review and evaluate this information.
