Methods/Success Criteria section of the permit package, clarifying that the <br />quantitative success demonstration methods and criteria apply solely to the <br />Fish and Wildlife Habitat postmine land use areas, and that success of <br />revegetation on reclaimed IndustriaUCommercial postmine land use areas <br />will be based on qualitative assessment of "ground cover sufficient to control <br />erosion", pursuant to Rule 4.15.10(2), on alternative land use areas not <br />designated as "Active Areas" or "Steep Rock Face" on Exhibit 6C-A. <br />21. DRMS requested that SCC address interim stabilization of azeas disturbed for <br />material borrow at the UTL azea. Operator responded that the disturbances would <br />be seeded with the approved interim seedmix. Item Resolved. <br />2.05.4(2)(f) Debris Disposal <br />22. DRMS requested that SCC clarify in the appropriate section of the reclamation <br />plan narrative that all exposed coal residue or coal waste in the alternative land <br />use area will be properly covered with non-toxic material or hauled to the CRDA- <br />1 waste disposal site. Narrative on page 14-8 of the permit package was properly <br />amended. Item Resolved. <br />2.05.5(2) and 4.16.3 Postmining Land Use/Alternative Land Uses <br />23. DRMS requested that SCC provide amended narrative addressing the <br />requirements of 2.05.5(2)(a)(iii), and, for disturbed lands within the permit area, <br />to provide copies of the surface owner comments concerning the proposed <br />postmining land use as required by 2.05.5(2)(b). Operator response included a <br />consent letter from Snowcap Coal Company (the pennittee), the owner of the <br />major portion of the South Portals disturbance area. Rudy Fontanari is the surface <br />owner of a smaller portion of the disturbed area at the north end, including a <br />lower segment of the existing Access Road A. Operator response indicated that a <br />certified letter had been mailed to Mr. Fontanari requesting his comments, but that <br />to date, no response had been received. <br />Please include a copy of the comment request letter and certification <br />documenting that it was sent to Mr. Fontanari, for inclusion in the permit <br />application. Please also provide a copy of written response from Mr. <br />Fontanari (if and when received) for inclusion in the permit application. <br />24. DRMS requested that SCC provide a schedule in accordance with the <br />requirements of 4.16.3(2), detailing the proposed use of each of the buildings <br />proposed for retention, and approximate date for initiation of use of each facility <br />under the alternative land use plan (including the RSRDA storage area). DRMS <br />further requested sufficient information regarding the Providence Place, Inc. <br />business enterprise, to demonstrate that use of the facilities by Providence Place, <br />Inc. is feasible and sustainable on a long term basis.
