• D R,A~T <br />Subject To Board Approval <br />Minutes, October 21-22, 1992 <br />39 <br />made by the Board, regarding the Division providing written <br />updates on a monthly basis. <br />Mr. Roger Flynn, an attorney representing the, Peoples <br />Alternative Energy Services, agreed with the Board's consensus <br />that it was no longer necessary to bring this matter before <br />the Board each month. He briefly addressed the issue of the <br />operator's non-compliance with permitted cyanide <br />concentrations. It was noted that no other parties were <br />present for today's Meeting. <br />It was MOVED that the Board entrust the Division with <br />continuing the review of the progress at the Battle Mountain <br />mine, that they be updated, in writing, as to progresses being <br />made, and that only matters be brought before the Board when <br />a problem is noticed or a possible violation has occurred. <br />SECONDED AND PASSED UNANIMOUSLY (Cooley, Stewart, Jouflas, <br />Danielson, Danni and McCannon); Kraeger-Rovey not present for <br />the vote. <br />Staff Presentation by Harry H. Consideration of a request <br />for reconsideration of a civil penalty and the need for a <br />reclamation permit. <br />Staff presented EXHIBIT A, a presentation form and two, <br />undated letters from the operator discussing completed <br />reclamation. Staff said the operator was previously found in <br />violation for mining without a permit, ordered to obtain a <br />reclamation permit and to pay a $160 civil penalty. <br />Staff said the operator had provided proof that reclamation <br />work at the site has been completed. The operator informed <br />the Division that he did not plan to conduct further mining at <br />the site and requested that the civil penalty be dismissed. <br />Staff recommended that the Board dismiss the civil penalty <br />previously imposed and the Order to obtain a permit. <br />
