March 26, 2002 <br />Page 6 of 12 Pages <br />stream where the upstream watershed is at least 1 square mile, or in the channel of an <br />intermittent or perennial stream unless specifically approved by the Division in accordance with <br />applicable sections of 4.05.1, 4.05.2, 4.05.4, and 4.05.18. <br />The proposal is in compliance with this rule. No road is in the channel of any stream. <br />Rule 4.04.3(2)(c) Stream fords of an ephemeral stream where the upstream watershed is at least <br />1 square mile, intermittent or perennial streams are prohibited unless they are approved by the <br />Division and will not adversely affect stream sedimentation or fish, wildlife, and related <br />environmental values. All other stream crossings shall be made using bridges, culverts, or other <br />structures designed, constructed, and maintained to meet the requirements of 4.03.3(4). <br />No ephemeral stream with an upstream watershed of a least 1 square mile is crossed by any of <br />the proposed roads. Existing roads do cross perennial streams above Minnesota Reservoir and in <br />Sylvester Gulch. <br />Rule 4.04.3(2)(d) Light-use roads shall be located to minimize down-stream sedimentation and <br />17ooding. <br />The proposed and existing roads are in compliance with this rule. <br />Rule 4.04.3(2)(e) See the rules for this rule. The application is in compliance by exception as no <br />light-use road is proposed for conversion into a haul road. <br />Rule 4.04.3(2)(flLight-use roads shall not be located in wet, steep, or unstable areas where <br />complete reclamation under 4.03.3(7) cannot be accomplished. <br />Proposed roads located on north-facing slopes and on areas of steep sideslopes will require <br />attention. Such roads are those to drill pads for targets 21-07, 21-08, 22-03, 22-03b, 22-07, 22- <br />08, 23-04. <br />Rule 4.04.3(3) Design and construction. Field-design methods may be utilized for light-use <br />roads. <br />Field design is proposed in conjunction with a representative of the USFS. <br />Rule 4.04.3(3)(a) Vertical Alignment. Except forpre-existing roads, roads within the disturbed <br />area in accordance with 4.05.2(4), or where lesser grades are necessary to control site-specific <br />conditions as approved by the Division maximum road grades shall be as follows: <br />Rule 4.04.3(3)(a)(i) The overall grade shall not be steeper than lOh.•I v (10 percent). <br />
