Long <br />Montrose, CO 81401 Division Director <br />RE: Denial of Succession of Operator Request, Ellison Mine, Permit No. M-78-342 <br />Dear Mr. Flanigan: <br />You are hereby noticed that on December 20, 1995 the Division denied the request for <br />succession of operator from Ryan Ltd. to Blake Mining Co. because Blake Mining Co. failed <br />to submit an adequate financial warranty, as required by Stipulation No. 1 of the <br />December 7, 1992 approval letter, within a reasonable amount of time. <br />Ryan Ltd. is still operator/permittee of the Ellison Mine, Permit No. M-78-342, and will still be <br />responsible for all provisions of the permit as well as those specified in the Mined Land <br />Reclamation Act and the Mineral Rules and Regulations. <br />Blake Mining Co., pursuant to Rule 1.12.2 and Rule 1.4.7, may file an appeal of the Division's <br />decision with the Mined Land Reclamation Board within sixty (60) days of the date of the <br />decision. Or, as an alternative, Blake Mining Co. may submit a new request for succession <br />of operator. <br />The referenced mine will be removed from active status and returned to temporary cessation, <br />which means you only have three more years of T.C. then you will have to either begin <br />reclaiming the site or reactivate mining operations, since you are not allowed to exceed 10 <br />years of temporary cessation. <br />An inspection of the site, weather permitting, will be conducted in February or March of 1996. <br />At that time the financial waranty requirement will be re-evaluated. <br />If you have any questions give me a call. <br />Sincerely, <br />~~ /~ <br />James Dillie <br />Environmental Protection Specialist <br />MiO55WnMFlengen.p <br />
