It was noted that the Board <br />unofficially established November 30, 1992, as a target date for <br />compliance. <br />It was MOVED that the Boartl adopt a resolution complimenting Jim <br />Pendleton and DMG Staff for provicing a very clear and concise report <br />on the status of this matter and for making a very difficult subject <br />very understandable. SECONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, <br />Cooley, Jouflas, Stewart, Danielson, Danni and McCannon). <br />Staff Presentation by James C. Stevens: <br />29. FORMAL PUBLIC HEARING <br />TOWN OF TELLURIDE File No. N/A <br />Box 397 <br />Telluride, CO 81435 <br />All persons wishing to give testimc>ny were sworn. <br />Sec. (unknown), T42N, R9W, N.M.P.M., San Miguel County, approximately 1 <br />acre; Surface gravel operation. Consideration of a request for a <br />Declaratory Order exempting activity involving annual gravel removal <br />from the San Miguel River from the requirement of a reclamation permit. <br />Staff presented EXHIBIT A, a July 27, 1992 letter from the operator and <br />a petition for a Declaratory Order. <br />Mr. Bill Frownfelter, the Director of Public Works for the Town of <br />Telluride, explained that the activity being proposed includes removal <br />of about 500 to 1,000 cubic yards of gravel deposits from the San <br />Miguel River each June, in order to prevent erosion of the banks, as <br />well as for flood prevention. He said they have been conducting this <br />type of activity for about 20 years. <br />Mr. Frownfelter said they contacted the Corps of Engineers, who have <br />provided approval for this work. in the past, and requested a written <br />approval to conduct the work this year. He said that after a copy of <br />the Corps of Engineers' approval was sent to the Division, he became <br />aware of the Division's requirements. <br />Mr. Frownfelter showed the Board an aerial photograph of the site and <br />discussed the proposed activity in detail. He explained that the <br />gravel deposits in the San Miguel river bed eventually push the channel <br />to the outside causing excessive erosion to the banks and a flood risk <br />for the Town. He explained that the material removed is not sold and <br />that reclamation will occur naturally. Mr. Frownfelter answered <br />questions from the Board. <br />It was MOVED that the Board adopt a Declaratory Order exempting this <br />operation from the requirement of obtaining a reclamation permit, with <br />the understanding that the Order is based on the situation as desc~~ibed <br />today. SECONDED AND PASSED UNANIMOUSLY (Kraeger-Rovey, Cooley, <br />Jouflas, Stewart, Danielson, Darni and McCannon). <br />
