Cyanide levels in the active or lower <br />tailing ponds have been reduced to about 4 ppm WAD. The inactive or <br />upper tailings pond is at a range of about 0.4 ppm. Staff said TR-10 <br />was approved on July 31, 1991, and the operator is proceeding with the <br />construction for installation of the INCO process. <br />Staff referenced an August 24, 1992 memo included in Exhibit A and <br />addressed the issue of long term detoxification of the tailings in the <br />pond. Staff said the matter should be addressed through the operator's <br />ultimate compliance with abatement requirement no. 8, which states that <br />this will be done 180 days after the ponds had been brought into <br />compliance with permit cyanide standards. <br />In reference to a request the Board had made previously, Staff <br />presented a "draft" Interim Order Concerning Detoxificatioi and said <br />the operator had indicated that the INCO process should be installed by <br />the end of September and that the facility should be functioning in <br />compliance at the spigot by mid-October. Therefore, in re~•ponse to a <br />request from the Board, Staff said that, if necessary, the Division <br />would recommend that November 30, 1992 be imposed as the date for the <br />operator to bring cyanide levels into compliance with permitted <br />standards. However, Staff explained that the Division's opinion is <br />that the Board has given the Division the direction and aithority to <br />supervise the operator's progress toward doing everything possible to <br />achieve the lowest cyanide levels and compliance with permitted <br />standards as fast as possible. <br />Mr. Andre' Duchane, representing the operator, said the company would <br />place a tank of hydrogen peroxide in the area of the collection pond, <br />in order to further treat the pond and maintain reduced cyanide levels. <br />Mr, Dean Massey, an attorney representing the operator, said the <br />Staff's presentation accurately represented activities being conducted <br />at the site. He said the operator is not satisfied that the order <br />proposed by Staff is necessary, because of the continuing Board Order <br />already in effect. Mr. Massey introduced the operator's new site <br />manager, Ken Kluksdahl. <br />Ms. Nora Jacquez, representing the Costilla County (:onservancy <br />District, and Mr. Roger Flynn, representing the People's /alternative <br />Energy Services of San Luis, addressed the Board briefly. Ms. Jane <br />Kircher, another party, was also present. Mr. Flynn <aid their <br />concerns relate to compliance of the collection pond, as well as <br />setting a deadline for compliance to occur prior to a hard freeze. Ms. <br />Jacquez discussed concerns regarding cyanide levels as it elates to <br />flooding from heavy rains and community notification in these instances. <br />
