Smith [9701 242-0270 p.3
January 12, 2005
• Areas 9, 17, and 19 comprise a continuous previously disturbed area that was reclaimed as
described under Area 19. The combined acreage for these areas is 6.3 acres (see below).
All higher elevation Areas (above elevation of 8,200 feet}, with exception ofthe Ventilation Fan
Housing and Shaft azea (within Area 19), have been reclaimed and qualify for bond release. This
includes Areas 5, 6, 7, 8, 9, 10, 12, 16, 17, and 19, a total of 13.41 acres. All of this acreage, with the
exception of approximately 0.2 acres associated with the Ventilation Fan Housing and Shaft was
reclaimed in the 1980's. The Ventilation Fan Housing and Shaft were reclaimed in the summer of
2003 (see Technical Revision No. 4, February 2004) and reseeded in the fall of2004. Vegetation
associated with the Ventilation Fan Housing and Shaft reclamation has not yet been established.
Therefore, the total acreage reclaimed far these areas is approximately 13.21 acres,
(n the fall of 2004, Area 10, the former Helo Pad, was converted to a runoff stack pond for Mr. Ned
Prather, a local rancher. All reclamation fences previously installed to protect revegetation of disturbed
road spurs adjoh~ing Area 18 were removed in the fall of 2004. Area 20, a top soil storage area, has
been reclaimed, however, in the event that GSHI is in need oftop soil for reclamation of Areas 2, 3, and
4, this top soil area maybe removed and transported to the mine bench. if, re-disturbed, the top soil
storage area will be revegetated consistent with methods used on mine roads and benches. This will be
addressed in a future technical revision to the mine permit. Area 13, Miscellaneous Access Roads, are
partially reclaimed and portions qualify for bond release at this time. The miscellaneous access roads
are designated by general area in Exhibit E, and Table 2.0 (Attachment A) shows each road's specific
reclamation status.
Based on DMG's observations during the site visit of September 16, 2003 and the explicit identification
of these areas in the above tables, the total acreage of reclaimed land is 35.4 acres, not including Area
18, the Logan Wash public road. Exhibit E states that the public road will not be reclaimed as access is
needed to private and public lands beyond the mine site.
For detailed information on rnine reclamation plans, please refer to Technical Revision No. 4-Revised
Reclamation Plan far the Logan Wash Mine (TRNo. 4) submitted by W WL in February 2004. The
purpose of TR No. 4 was to formal ly present modifications to the original reclamation plan that was
originally prepared and revised in 1981. TR No. 4 coven general grading and revegetation efforts at
the mine as welt as procedures to close and seal three open portals and one ventilation shaft. The
original plan did not address details of portal or shaft closure. The TR contains specific information on
constmction ofthe portal seals and reclamation ofthe evaporation pond.
In accordance with Rule 4.16.1, W WL believes the information provided above meets the requirements
of Rule 4.16.1{1), which states that a written notice of completion and release of responsibility of
reclaimed lands be provided.
Information designated in Rule 4.16.1(2) requires contact information ofthe mine owner(s) as follows:
Mr. Franklin Miller
Vice President, Operations
Occidental Oil Shale, Inc.
(or Glenn Springs Holdings, Inc.)
2480 Fortune Drive, Suite 300
Lexington, KY 40509
Phone: 859-543-2154
Fax: 859-543-2171
W....s.....
