The Water Judge sitting in this Court has juris- <br />diction over the subject matter of the proceedings and over <br />all who have standing to appear as parties therein, whether <br />they have appeared or not. <br />4. The parties to this proceeding have entered into <br />a stipulation, the terms and conditions of which are incor- <br />porated in this Decree and accepted by the Court as being <br />just and reasonable and by incorporation and inclusion <br />herein Objectors agreed to withdraw their Statements of <br />Opposition. <br />5. Applicants own an undivided two-thirds interest <br />in the water rights of the Rist and Goss Ditch described as: <br />Rate <br />of flow <br />6.406 cfs <br />80.072 cfs' <br />Priority No. <br />9 <br />29 <br />Priority <br />Date <br />riarch 20, 1866 <br />April 15, 1875 <br />Decree <br />Hato <br />clay 28, 1883 <br />May 28, 1883 <br />(cfs means "cubic feet per second of time.") <br />Applicants' ownership of said water rights entitles them to <br />9.27 cfs of Priority No. 9 and 53.38 cfs of Priority No. 29. <br />The remaining one-third of the water rights of the Rist and <br />Goss Ditch are claimed to be owned by Homer Loomis (Loomis) <br />and are not included in this proceeding. <br />6. Applicants may modify the exercise of their rights <br />in the Rist and Goss Ditch in the manner hereinafter set <br />forth: <br />A. Applicants' use of water out of Priority 9 <br />shall be limited to 4.27 cfs during the period from <br />April 1 through October 31 of each year hereafter, <br />provided, however, that the diversion shall also be <br />limited as follows: <br />(1) Applicants shall curtail all diversions from <br />October 1 to October 31 of each year here- <br />-after for municipal use to the extent that <br />such diversion precludes the availability of <br />-2- <br />
