ROCKCASTLE/CMLRD <br />DRAFT AGREEMENT <br />5/30/90 <br />of this Agreement. <br />6. The reclamation activities specified herein, will <br />commence on or about June 1, 1990. The reclamation activities <br />specified herein will be completed by October 31, 1990. The date <br />of completion of reclamation shall be extended by mutual agreement <br />of the Division and Rockcastle if the reclamation activities are <br />delayed due to weather conditions or other circumstances beyond the <br />reasonable control of Rockcastle. <br />III. ROADS AND SEDIMENT PONDS -- The Division and Rockcastle agree: <br />1. That all haul roads at the site shall remain in their <br />current configuration after site reclamation to provide site access <br />in support of the post-mining land use. The Division and <br />Rockcastle agree that the Reclamation Plan contemplates retention <br />of these roads and that the surface landowner has requested that <br />these roads remain after site reclamation; and, <br />2. That sediment Ponds 2, 3 and 5/6 and the drainage <br />controls associated with these ponds will be removed upon <br />submission of a technical report demonstrating that the disturbed <br />areas controlled by the ponds meet the criteria of 2 CCR 407-2, <br />Rule 4.05.2. <br />a. Alternatively, the Division and Rockcastle agree <br />that Rockcastle may retain sediment Ponds 2, 3, 4, and 5/6 as <br />permanent impoundments after final site reclamation as stockwater <br />ponds in support of the post-mining land use provided that <br />Rockcastle submits information to the Division pursuant to Rule 2 <br />CCR 407-2 and Rule 4.05.9(1) demonstrating that Ponds 2, 4, and <br />-3- <br />
