Enclosed are 4 application <br />forms with the revisions made as requested. Please replace the <br />forms in the books in your possession. <br />Thank you for bring this to our attention. <br />Exhibit C - Pre- Mining and Mining Plan Map <br />1. Please refer to the Legal Descriptions submitted in the <br />Apache 9 and 9A applications. You may note in the applica- <br />tions for Apache 9 and 9A that there were no distinct <br />outlines. But rather maximum disturbance areas. <br />2. Note on Map Exhibit C, Affected Lands; the area outlined <br />with a broken line. These areas are the Pre-law disturbance <br />areas. Robinson does not know at this time which areas will <br />be re-disturbed. This will depend on the areas to be mined <br />and the demands for clay/brick in the market place. If <br />these areas are re-disturbed Robinson realizes they will be <br />responsible for reclamation in these areas. <br />3. If Robinson plans to mine within 200 feet of any man made <br />structure (buildings) they will get a mitigation agreement <br />~~~j with the owner of that building prior to commencement of <br />F^v~•~ mining within the 200 feet. I have argued with the staff <br />before about the Legislatures intent when they used the word <br />"Structure" in the law. I still maintain their intent was <br />
