32. Rule 2.03.6: Map 23, "Mine Plan" (certified 9/l0/99), appears to indicate that development mining is being applied for in the north halt of Section I0, TSN, R86W (Gateroads l8 Right and 19 Righq in conjunction with the application for PR-0~. Existing permit pages 2.03- 2=1(x) (rev. 4/18/96) and 3.03-24 (rev. l0/Ol/97) include the following text "TCC also agrees that: (c) For those areas where such right-of-entry has not already been secured, acceptable right-of-entry information will be submitted before mining-related activities commence. Such areas include lands in the north''/z of Section ]0, TSN, R86W, and the southwest 1/a of the southwest''/a of Section 33, T6N, R86W." It seems that TCC now possesses the right to enter and extract coal from Section 10, TSN, R86W, as it is stated on existing permit page 2.03-32 (rev. 10/01/97) and proposed permit page 2.03-32 (rev. 12/l0/98) that: "Colorado Lease CO-3229 gives Cyprus the right to mine coal from the lands described below. The effective date of the lease 12/4/93..." '...Section l0: All..." If TCC has the right to enter and mine coal from Section 10, TSN, R86W, then please revise paragraph "(c)" on existing permit pages 2.03-24(x) (rev. 4/18/96) and 2.03-24 (rev. 10/01/97) by removing the reference to the land in Section 10, so that this pazagraph does not seem to indicate that TCC does not possess the right to enter this land. 33. Rule 2.03.6: Proposed page 2.03-33.1 (rev. 2/24/99) describes State Lease 3229 in Section 32, T6N, R86W as "NE'/a NE'/a; S'/z NE'/a; W'/z; E'/z SE'S ". Map 2, "Coal Ownership" (certified 2/4/00), seems to add the W '/z of the SE'/a of Section 32 to this lease description. Please address this appazent discrepancy. 34. Rule 2.03.6: Map 2, "Coal Ownership" (certified 2/4/00), depicts two particular tracts of "State" coal that in the permit text do not seem to be associated with any State lease. These tracts aze in Section 12, TSN, R86W. One is in the NE'/a of the NW '/a, and the other is in the NW '/a of the NE'/. If these tracts are in fact part of a State lease, please indicate where in the current permit they are described as State coal tracts. If they have not been properly described in the permit's text, please revise the permit's text to do so. 35. Rule 2.03.6: State Coal Lease CO-3229 is described on proposed permit page 2.03-33.1 (rev. 2/24/99) in Section 13, TSN, R86W as "Section 13: SW'~b NW'~b; S'/z SW'/a;...". Based upon the depiction of the lease in Section 13 shown on Map 2, "Coal Ownership" (certified 2/4/00), it appears that this should read "Section l3: SW'/a NW'/a; W '/z SW'/a;...". Please address this apparent discrepancy.
