The responses were discussed with Dan <br />Mathews as per your recommendation. The concern number is presented <br />followed by Empire's response: <br />16. Attached are copies of pages from a 1984 submittal to the Division which <br />identified material being taken from the refuse pile area and placed at the No.S <br />Portal. The submittal was approved by the Division and the volume of material <br />located adjacent to the refuse pile and hauled to the No. 5 Portal was <br />appropriately discussed in the text of the permit. A limited amount of material <br />was placed in the refuse pile during the early 1980's. Since the No.9 Portal <br />was approved as a site for placing refuse material the original pile has not been <br />used. It is estimated that less than a 0.5 acres has refuse material on it in the <br />original pile. If the material is placed to a depth of 3.5 feet then approximately <br />2,800 CY yards would have to be placed over the refuse. There is sufficient <br />material available in stockpile to meet this requirement. <br />19. The reference to the t-test has been eliminated from page 2.05.4-24Rb in <br />reference to the success determination for the grain crop. In regazds to the <br />irrigated hayland, total field harvest will be used to determine production. The <br />production standard for the No. 5 Portal is presented on page 2.05.4-24RB. <br />21. Page 2.05.4-32R has been revised to clearly state that herbaceous <br />production will be measured and not total production. <br />23. a.) No response necessary. <br />23. c and g) The text has been clarified to show that the No. 9 Portal azea, <br />which includes the refuse disposal site, will be returned to pastureland. Also, <br />the text has been revised to show that the pastureland seed mixture will be <br />
