Dear Ms. Crosby:
The following represent Empire's response to the Division's concerns presented
in its letter of February 13, 1997. The responses were discussed with Dan
Mathews as per your recommendation. The concern number is presented
followed by Empire's response:
16. Attached are copies of pages from a 1984 submittal to the Division which
identified material being taken from the refuse pile area and placed at the No.S
Portal. The submittal was approved by the Division and the volume of material
located adjacent to the refuse pile and hauled to the No. 5 Portal was
appropriately discussed in the text of the permit. A limited amount of material
was placed in the refuse pile during the early 1980's. Since the No.9 Portal
was approved as a site for placing refuse material the original pile has not been
used. It is estimated that less than a 0.5 acres has refuse material on it in the
original pile. If the material is placed to a depth of 3.5 feet then approximately
2,800 CY yards would have to be placed over the refuse. There is sufficient
material available in stockpile to meet this requirement.
19. The reference to the t-test has been eliminated from page 2.05.4-24Rb in
reference to the success determination for the grain crop. In regazds to the
irrigated hayland, total field harvest will be used to determine production. The
production standard for the No. 5 Portal is presented on page 2.05.4-24RB.
21. Page 2.05.4-32R has been revised to clearly state that herbaceous
production will be measured and not total production.
23. a.) No response necessary.
23. c and g) The text has been clarified to show that the No. 9 Portal azea,
which includes the refuse disposal site, will be returned to pastureland. Also,
the text has been revised to show that the pastureland seed mixture will be
