Submittal of a Technical <br />Revision will be required to address this design change. <br />One option to consider may be to relocate the sediment pond on the <br />eastern side of the access road, where the old pre-law highwall and <br />cleared area exist. The current ditch that ends at the culvert <br />intake could be extended to the new pond down the road. <br />3. The third and final issue concerns the slope stability of the <br />road cut areas. Per Rule 4.03.2(3)(c), all roads cuts that are <br />steeper than 1.5H:iV in unconsolidated materials or .25H:1V in rock <br />need to have a geotechnical analysis demonstrating that a safety <br />factor less than 1.5 will not result in significant environmental <br />harm or harm to the public health and safety. If this cannot be <br />demonstrated, then appropriate mechanical structures need to be <br />constructed to ensure stability on the road cut slopes. Road cuts <br />to be addressed include: the tipple access road (per issue$14 in <br />the Mid-term Review), the access road to the refuse pile, and the <br />access road to the upper bench. <br />This concludes the Division's review of the issues discussed on <br />August 31, 1993.
