DMG has completed an
adequacy review of your application for conversion of the existing I lOc permit into a 112c permit.
This application caltnot be approved until the following issues are adequately addressed. Failure to
respond before the August 20'I', 2001 decision date will result in the applicatiolt being denied. A
written request for alt extension to the decision date may be advantageous for Farmer Construction and
this Office to adequately respond to these issues.
Adequacy Issues:
1) There is no documentation of the timely publication of the Public Notice in a newspaper of general
circulation in the locality of the proposed operation for four consecutive weeks as required by Rule
1.6.2(1)(d). Please provide proof that this notice was published within 10 days of filing the
application with [Iris office, once a week, for four consecutive weeks. If no proof of publication
can be supplied, the public notice procedure and all applicable deadlines must begin to run anew
per Rule 1.6.6.
2) Bureau of Land Management, [he property owners along the south permit boundary, appear not to
have been notified. Please provide verification that BLM has been notified as required by Rule
1.6.2 {e) {ii). if the BLM was not adequately noticed, by rule, the public comment period "shall
begin to run anew". This includes all applicable deadlines for comment attd decisions.
3) All maps are required to have the signature of the qualified individual who prepared them per Rule
6.2.1 (2)(b). Please supply ne~v maps with ttte required signature and the noted required changes
listed below.
4) Contour lines in exhibit maps change intervals. Contour lilies outside the permit area are 20 foot,
while those within the area are 5 foot. Please provide maps with consistent contour intervals.
5) On the map stowing Exhibits E and F, the Reclamation Plan is mislabeled as "Exhibit D". Please
correct so that Exhibit E is the Reclanttion Plan and resubmit these Exhibits.
6) The Mining Plan calls for the stockpiling of overburden for future reclamation. Please contntit to
the separation of topsoil from the overburden waste This will insure better preservation of the
-~iiii~«rllllllll~
