November 2005 Hayden Gulch Mine • Final Bond Release Application 1Page 14 <br />In the CDMG's MR-13 Proposed Decision letter dated May 13, 1998, Mr. Tom <br />Kaldenbach (CDMG Environmental Protection Specialist) to Mr. Michael <br />Neumann (TenaMatrix Project Manager), CDMG outlined the extended <br />reclamation liability period for the highwall slump area and the three shrub <br />augmentation pazcels (CDMG, 1998). In the letter, CDMG explained "The bond <br />release liability period for the slump was reinitiated in September 1994 when a <br />french drain was installed. Reinitiation of a full 10 year liability period for <br />substantial work on the slump is required by Section 4.15,7(5). Therefore, the <br />liability period for the slump will end in the year 2004..." The letter went on to <br />further state `fls established in TR-62, the bond release liability period for the <br />shrub augmentation parcels was reinitiated for an additional five years. The five <br />year period commenced June 6, 1996, the day following the completion of the <br />initial planting of the parcels. The reinitiated liability period is only five years <br />duration, rather than ten years, because the shrub parcels were considered to be a <br />restrictive transplanting of native species as allowed in Section 4.15.7(5). The frve <br />year period was assigned to the parcels as f the initial planting of the parcels had <br />occurred at the end of the fifth year of the permit area's original ten year liability <br />period. The five year liability period will end June S, 2001... " <br />' 2. Documentation that Revegetation Success Criteria as required by Rule 4.15.8 have been <br />' Achieved for the Last Two Consecutive Years: <br />• Appendix A, Vegetation Monitoring for Final Bond Release, presents results of the <br />2004 and 2005 vegetation sampling data. As discussed above in Section 1.2, the <br />revegetation success criteria for the four pazcels has been met. <br />Consequently, the four pazcels that currently constitute the Hayden Gulch Mine <br />permit area meet the revegetation bond release criteria of Rule 4.15.8 and the <br />reclamation and revegetation standards set forth in the approved Hayden Gulch <br />Mine permit. <br />4. Documentation that the Approved Post-Mining Land Uses have been Achieved: <br />• The approved post-mining land uses are wildlife habitat and livestock grazing. <br />Various operator and CDMG inspections serve to document that the post-mining <br />land uses have been achieved, Wildlife have been allowed unrestricted use of this <br />area throughout the reclamation and closure period except for the shrub enclosure <br />areas. Elk and deer sign in the form of tracks and droppings are abundant <br />
