condition of being infested with noxious weed seed, or that it will be allowed to become infested <br />while stockpiled. <br />7. It appears from the narrative that this will be an ongoing activity, as long as there is a location <br />to place such imported materials. My observations during the last inspection are that there is a <br />legitimate need for these materials along the existing vertical highwall on the east. Your <br />reclamation plan requires that final slope gradients be no steeper than 5:1. Therefore, it is <br />assumed that backfilling will continue at least until that 5:1 slope is attained. If slopes even less <br />steep are desired, by importing and placing backfill materials, this office has no objection. <br />8. Your proposal also states that as additional areas along the east are mined, additional locations <br />will become suitable for placement of imported materials. Please corm whether you are stating <br />that mining will proceed along that highwall in a near vertical manner, and the proposed <br />backfilling of imported material will continue beyond the presently available areas into those new <br />areas. <br />Please note that, if approved, such importing and backfilling activities will become part of your <br />approved reclamation plan, and should be included in your annual report as long as it continues <br />I will await your responses to these questions to make my decision on this technical revision. <br />Please respond at your earliest convenience, so that the revision becomes adequate, and you may <br />proceed with the project. The submittal of this technical revision has abated the outstanding <br />problem noted in the April I5, 2002 inspection. <br />The decision date is set for July 5, 2002. If the revision is not adequate for approval by the close <br />of business on that date, the revision may be denied.
