During the last two years of the <br />10-year responsibility period Section 816.166(b)(1)(ii)] both the <br />revegetated and the reference areas will be grazed to a limmited <br />extent as described in Section 816.115 and in Section 780.23(a). <br />Revegetation Success - Kerr Tipple Area <br />• Revegetation success at the Kerr Tipple Area will be measured <br />through the use of a reference area situated approximately 1,500 <br />feet east of the tipple. This site was suggested as a potential <br />reference area for the tipple area by Ms. Carol Pahlke of the MLRD <br />at a meeting with Kert Coal representatives on October 3, 1980. <br />The appropriateness of this site was reaffirmed by Mr. Kevin Allred <br />of OSM and Ms. Catol Pahlke of MLRD a[ a meeting on November 10, <br />1980. Since the Kerr Tipple Area was disturbed prior to required <br />topsoil salvage and pre-disturbance vegetation data collection, <br />compliance with Rule 4.15.7(3)(b) stipulating statistical compari- <br />sons between premine and reference area is not feasible. Conse- <br />quently, the Kerr Tipple reference area shown on Map 19a was <br />approved by the Division under Rule 4.15.7(3) which allows for the <br />approval of reference areas which are not necessarily representa- <br />tive of the premine plant commmunity. <br />In the case of the Kerr Tipple Area, the reference area is similar <br />to the expected reclaimed plant community.
