Lessee shall pay -twenty-f ive_ _ ( ) per ton for <br />-y;~;,~,~: ~„' cents 50.25 <br />"~.,h~~,=~ all sand and gravel removed from the Leased Premises. <br />B. lio royalty shall be payable to Lessors unless and until mater- <br />ial 'is removed from the Leased Premises. Lessee shall weigh or <br />measure all material and shall provide Lessors with a written <br />staterent (including copies of daily stale tickets or compu- <br />tations of measurement, if requested) as to all materials <br />removed from the Leased Premises in the preceding month and <br />make payment to Lessors for the royalty due therefore by the <br />15th day of each month for material removed in the preceding <br />month. Payment for such royalty shall be by check payable to <br />the order of Lessors unless otherwise directed in writing by <br />Lessors at a time subsequent hereto. , <br />4.3 All payments contemplated by this Lease Agreement shall be <br />made to ROBERT D. MILLER and BEVERLY R. MILLER at their address desig- <br />noted in Section 70.1 hereof. <br />5. REMOVAL OF EQUIPMENT RND IFIPROVLMENTS. <br />5,1 Upon termination of this Lease Agreement far any reason, all <br />personal property of Lessee located within or upon t}~e Leased Premises, <br />including machinery, equipment and tools used by Lessee on the Leased <br />Premises,. and 'all improvements upon the Leased Premises, shall remain on <br />the Leased Premises and be held as a guarantee until all terms of this <br />Lease Agreement shall have been complied with. Upon such conpliance <br />with said terms, Lessee shall remove all such personal property and <br />improvements from the Leased Premises unless Lessee shall have received <br />the written consent of Lessors to the non-removal of any improvements. <br />In the event Lessee shall fail to remove such personal property and <br />improvements within sixty (60) days after Lessee is entitled to remove <br />the same, Lessors shall, at their election, become the owners of said <br />personal property or improvements or Lessors may have the same removed <br />from the Leased Premises at Lessee's expense. <br />6.
