The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 1 16,
Paragraph 4, of the Colorado Revised Statutes, that on August 16, 2005, an application to revise coal mining
operations at the Edna Strip Mine was considered complete for the purposes of filing. The revision was submitted
by The Pittsburg & Midway Coal Mining Co. All review and comment periods as provided in the Act and the
Regulations initiate from this date of filing.
The revision revises the permit boundary. The area of the permit is reduced by withdrawing some 171.2 acres of
unaffected private land about the perimeter of the permitted area.
The Surface coal mining operation is on land located approximately 5 miles Northwest of Oak Creek, Colorado.
The permit area is further described as follows:
TSN, R85 W, Portions of Sections 31, 32
TSN, R86W, Portions of Section 36
T4N, R86W, Portions of Sections 12, 13, 14, 23, 24, 25
T4N, R85 W, Aortions of Sections 7, 8, 17, ] 8, 19, 29, 30
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Cow Creek, Oak Creek,
and Rattlesnake, Colorado.
The above referenced technical revision application would not incorporate additional lands into the permit area,
but rather reduces the permit area. Other than the area reduction, the technical revision does not otherwise alter
previously approved permit conditions or mitigation measures.
In order for us to approve this revision we are required [o make a finding that "the activities would not affect the
continued existence of endangered or threatened species or result in the destruction or adverse modification of
their critical habitats as determined under the Endangered Species Act of 1973...." Therefore, we request your
review and recommendation pursuant to this finding with regard to your agency's evaluation of the potential for
