performance standards. The NOV was properly abated and was terminated by the Division on November <br />23, 2005. A penalty of $800.00 was assessed by the Division on November 30, 2005, and was properly paid <br />by CAM on January 13, 2006. The operation is in compliance with the terms and conditions of the <br />approved permit. <br />Status of Previous Sfipulations <br />There have been no new stipulations attached to the permit subsequent to issuance of the February 19, 1999 <br />Mid-Term Permit Review. Previously resolved Stipulations 22, 23, 24, 25, 28 and 29 are discussed in that <br />document. Stipulations imposed and resolved prior to that time are addressed in the December 1996 <br />Findings Document for Permit Renewal No. 4. <br />Stipulation 26, which was included in the previous renewal permit decision has been eliminated and is not <br />included in the RN-06 proposed decision. The stipulation specified a date for submittal of the Annual <br />Hydrology Report each year. Amended narrative included in the permit via Technical Revision 15 includes <br />a commitment to submit the report by March 31 each year. <br />Summary of Permittin¢ Actions <br />Permitting actions processed subsequent to the March 19, 2004 mid-term review document and prior to <br />January 6, 2005, are summarized in the Permit Renewal No. 5 (RN-OS) Findings of Compliance Document. <br />Permitting actions processed since January 6, 2005, include three technical revisions (TR's) and four minor <br />revisions (MR's). These permitting actions are briefly described below, in chronological order: <br />TR-13 proposed approval decision was issued January 10, 2005. The revision provided amended design <br />detail for the McClane Canyon Mine Sediment Pond, including location of primary spillway gate valve and <br />elevation of pond bottom. <br />MR-36 proposed approval decision was issued March 3, 2005. The revision allowed for a short segment of <br />light use road in the sediment pond vicinity, to provide vehicle access to a power meter. <br />TR-14 proposed approval decision was issued October 26, 2005. The revision allowed for the installation <br />of new haul road Culvert "P", to re-connect upper McClane Creek to its original lower segment, and also <br />allowed for abandonment of diversion Culvert "F". <br />MR-37 proposed approval decision was issued December 1, 2005. The revision allowed for construction of <br />an emergency drill hole into the underground workings as ordered by the federal Mine Safety and Health <br />Administration (M5HA), to allow for monitoring of mine atmosphere following an explosion in the mine. <br />The revision also addressed construction of a temporary light use road to access the drill site, and included <br />plans for reclamation of the drill hole, pad, and temporary road. The revision approval included specific <br />authorization allowing for construction of segments of the light use road within 100 feet of an ephemeral <br />drainage. <br />MR-38 proposed approval decision was issued January 17, 2006. The revision incorporated <br />operatorlpermittee name change from Central Appalachia Mining, LLC to CAM Mining LLC. <br />TR-15 proposed approval decision was issued August 22, 2006. The revision incorporated numerous <br />updates and modifications to various sections of the approved permit. The revision was submitted by CAM <br />in response to concerns identified by the Division in the preliminary adequacy review of the Permit Renewal <br />No. 6 (RN-6) application.
