The stipulation was satisfied by submittal of TR-51, deemed complete on March 3, 2005. The <br />stipulation has been resolved and terminated. <br />Stipulation 35 was attached to the PRA proposed decision, issued November 17, 2004. The <br />Stipulation required completion of fmal grading of the segment of Haul Road "A" extending to the <br />east of the Haul Road "H" junction, by September 1, 2005. The Division's inspection report of <br />August 1, 2005 notes that final grading of the road segment to the approved configuration had been <br />substantially completed. The road segment was modified for postmine retention, and is now a <br />segment of the approved "Ridgeline Access Road". An "As-Built" report has been submitted for <br />the entire "Ridgeline Access Road". The stipulation has been resolved and terminated. <br />Stipulation 36 was attached to the PRA proposed decision, issued November 17, 2004. The <br />stipulation required submittal of properly certified Disturbed Area map Exhibit. The properly <br />certified disturbed area mapping was provided on revised Exhibit 12-2, which was included in the <br />PR-5 application submittal, deemed complete May 16, 2005. The stipulation has been resolved <br />and terminated. <br />Stipulation 37 was attached to the PRA proposed decision, issued November 17, 2004. The <br />stipulation required submittal of individual stock pond designs prior to construction of additional <br />stock ponds. The required information was submitted within PR-5 amended materials. The <br />stipulation has been resolved and terminated. <br />Stipulation 38 was attached to the PRA proposed decision, issued November 17, 2004. The <br />stipulation required submittal of wnstruction certification for existing stock ponds, and a <br />commitment to submittal of annual certifications for stock ponds. The stipulation was satisfied by <br />documentation provided in MR-57, approved February 5, 2005, in addition to 2004 annual <br />certifications. The stipulation has been resolved and terminated. <br />All stipulations that originated prior to approval of Permit Renewal No. 3 have been fully <br />resolved, and are no longer attached to the permit. Please refer to Section III-Status of <br />Stipulations, of the Division's December 22, 2003 mid-tenor review document for a summary <br />of the resolution of previous stipulations. <br />Summar~of Revisions Since PR-3 <br />Permit Revisions <br />PR-3 proposed decision (approval with condition) was issued May 1, 2003. Stipulation No. 30 <br />was attached. Approval of PR-3 allowed for continued mining within the South Extension of the <br />approved permit area. PR-3 approval authorized an additional 148 acres_of disturbance.toallow_ _ _ <br />for recovery of Sage Creek and Wolf Creek reserves, and 14 additional disturbance acres <br />associated with expansion of previously approved Wadge pit disturbance areas.
