approval also provided for modifications to the sediment control plan to handle the additional <br />disturbance associated with the Sage Creek/Wolf Creek mining area. Additionally, the Division <br />approved variances from the 180-day backfill and grading requirement of Rule 4.14.1(1)(c), for <br />specific locations. Finally, within PR-3, the Division approved a number of reclamation plan <br />amendments intended to enhance soil stabilization and vegetative diversity, and a field study to <br />evaluate irrigation and soil handling practices for successful establishment of site-native aspen <br />saplings. <br />PR-4 proposed decision (approval with conditions) was issued November 17, 2004. Stipulations <br />34, 35, 36, 37, and 38 were attached. The primary operational change associated with PR-4 was <br />the incorporation of highwall miner coal extraction to allow for maximal coal recovery following <br />extraction by conventional surface mining techniques, in specked final pit locations, In addition, <br />various updates to the ownership and control information section of the permit were included in <br />PR-4, refinements to the plans for design and certification of stock tank impoundments were <br />addressed, and "As-Built" designs for Sediment Pond 17 were provided. Reclamation liability <br />was increased by $756,373.00, and additional bond in the amount of $707,373.00 was submitted, <br />bringing to total bond held by the Division to $9,707,373,00. <br />Technical Revisions <br />TR~S proposed approval decision was issued November 5, 2004. The revision provided <br />information regarding temporary and permanent roads in response to permit stipulations 31, 32, and <br />33 (which had been attached to TR~2. The revision also modified postmine topography in <br />portions of the "A" Pit and "B" Pit areas, and revised permanent drainage channel designs in the <br />016 watershed. <br />TR-46 proposed approval decision was issued January 20, 2004. The revision extended backfilling <br />and grading timeframes for "B" Pit until 3/31/04 and Ridgeline "A" Pit until 12/31/04. <br />TR~7 proposed approval decision was issued February 19, 2004. The revision modified certain <br />aspects of the Aspen Study Plan, including schedule of work and plot layout. The revision was <br />submitted to abate Notice of Violation (NOV) CV-2003-015. <br />TR~8 proposed approval decision was issued August 20, 2004. The revision provided certified <br />"As-Built" reports for Haul Road "K", Pond 016A, and Pond 006 Phase V. <br />TR~9 proposed approval decision was issued May 5, 2005. The revision modified design plans <br />for the north portion of the Ridgeline Access Road, provided a remediation plan for a slump in the <br />"A" Pit reclaimed highwall, and provided a storage capacity survey for Sedimentation Pond 016A. <br />TR-50 proposed approval decision was issued December 12, 2005. The revision was in response <br />to the Division's mid-term permit review, and provided modifications to various aspects of the <br />approved mining and reclamation plan.
