SEP-9-2004 15:16 FROM: BILL & JRNE JRNKE 1-970-728-6315 T0: 19702475104 P.3 <br />Page 1 <br />Construction Materials Rule 1 <br />RULE 1: GENERAL PROVISIONS AND REQUIREMENTS - PERbIIT PROCESS <br />too 1.1 DEFINITIONS <br />(1) "the Act" refers to the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, Section 34-32.5-101, et seq., C.R.S. <br />1984, as amended. <br />(2) "Activit "for the purpose of protecting groundwater quality, <br />means any mining, storing, disposing, or processing operations, or any <br />reclamation operation or process that may dischazge or cause dischazge of <br />pollutants to groundwaters. <br />to3(t) -~ (3) "Affected Land" means the surface of an azea within the state <br />where a [Wining operation is being or will be conducted, which surface is <br />disturbed as a result of such operation. Affected lands include but shall not be <br />limited to private ways, roads, except those roads excluded pursuant to this <br />Subsection 1.](3), and railroad lines appurtenant to any such azea; ]and <br />excavations; exploration sites; drill sites or workings; refuse batiks or spoil <br />piles; evaporation or settling ponds; work, pazking, storage or waste dischazge <br />areas; and areas in which structures, facilities, equipment, machines, tools or <br />other materials or property which result from or are used in such operations aze <br />situated. All lands shall be excluded that would be otherwise included as land <br />affected but which have been reclaimed in accordance with an approved plan <br />or otherwise, as may be approved by the Board. Affected land shat] not include <br />off-site roads which existed prior to the date on which notice was given or <br />permit application was made to the office and which were constructed for <br />purposes unrelated to the proposed mining operation and which will not be <br />substantially upgraded to support the mining operation. <br />]03(1.5) (4) "Aeerieved" means suffering actual loss or injury, or being <br />exposed to potential loss or injury, to legitimate interests. Such interests <br />include, but aze not limited to, business, economic, aesthetic, governmental, <br />recreational, or conservational interests. <br />(5) "Ambient Groundwater Ouality" for mining operations <br />permitted prior to January 31, 1994, ambient groundwater quality shall mean <br />the quality of the groundwater at the mine site as of January 31, 1994.
