SEP-9-2004 15:16 FROM: BILL & JRNE JgNKE 1-970-728-6315 T0: 19702475104
September 9, 2004
Mr. Bob Oswald,
1 have several concerns about the Pathfmder Gravel Pit, File No M-1994-113. I
have previously stated my concern about the unstable slope along the access road to the
pit area. I was told by Steve Shuey and Mike Long that the filling of the wetland would
require an Amendment to the Permit. I have diligently followed the Meeting Agenda's
posted on your website, expecting notification of a Hearing for the activity at Pathfmder.
Here are a couple of references to support the reasons for requiring an Amendment.
My concerns for this slope are as stated previously. See `Finding of Fact and
Conclusions of Law' attached with this fax, #12.
Also attached, Rule 1 General Provisions and Requirements 1.1 Definitions (3)
Affected Lands. This road area is being constructed solely for the propose of mining and
related activities.
Also the San Miguel County Board of County Commissioners do not have
jurisdiction within the Permitted Boundary. Just as the NLRB determined that the
portion of the access road was not in their (NLRB) jurisdiction.
I will fax one engineering study that is critical of Pathfinder engineer's studies
and reports. I will mail several other engineering studies and reports that question the
findings of Pathfinder engineers.
Sincerely,
Bill 7anke
P.O. Box 642
Ophir, Co 81426
970-728-6315 phone and fax
bianke a telluridecolorado.net
P. 2
