I <br />have previously stated my concern about the unstable slope along the access road to the <br />pit area. I was told by Steve Shuey and Mike Long that the filling of the wetland would <br />require an Amendment to the Permit. I have diligently followed the Meeting Agenda's <br />posted on your website, expecting notification of a Hearing for the activity at Pathfmder. <br />Here are a couple of references to support the reasons for requiring an Amendment. <br />My concerns for this slope are as stated previously. See `Finding of Fact and <br />Conclusions of Law' attached with this fax, #12. <br />Also attached, Rule 1 General Provisions and Requirements 1.1 Definitions (3) <br />Affected Lands. This road area is being constructed solely for the propose of mining and <br />related activities. <br />Also the San Miguel County Board of County Commissioners do not have <br />jurisdiction within the Permitted Boundary. Just as the NLRB determined that the <br />portion of the access road was not in their (NLRB) jurisdiction. <br />I will fax one engineering study that is critical of Pathfinder engineer's studies <br />and reports.
