Stipulation No. 32 within the proposed decision for TR-22. The proposed language of the amended stipulation would read as follows: Stipulation No. 32 Prior to submittal of Phase I bond release application for the lower road to be retained for the postmining land use, the operator will submit a written request from the surface owner for retention of the privately owned segment of haul road (between the BLM boundary and State Highway 139). The request will indicate the surface owner's concurrence with the plan for road retention presented in permit section 3.3.1. Alternatively, a revised reclamation plan for the lower road segment demonstrating compliance with Rule 4.031(7)(a)(i) through (ix) will be submitted to the Division. Please let us know if the revised wording of the stipulation is acceptable to you. 7. The ditch design and riprap sizing information summarized on Table 3.9-3 is somewhat confusing, for anyone not already familiar with the permit. It would be helpful to title the table "Peak Discharge for Reclaimed Ephemeral Channels (Reclaimed Upper Road and Portal Bench)", and to include a reference to the map figures that depict the subject channels. Also, for the "Ditch Design" and "Riprap Sizing", sections of the table (presented separately from the "Drainage Basin Summary", it would improve the clarity of the presentation if initial column headings were changed from "Basin" or "Drainage Basin" to "Permanent Channel". Please amend the table to provide the requested clarifications. There are two ditch design summary tables for waste disposal area ditches; "As Constructed Configuration" is presented on page M(vii)-4, and "Interim Configuration" is presented on page M(vii)-29. It is unclear what the difference is between the "As Constructed" and "Interim" configurations, and it would be helpful to include explanation of the differences in the diversion channel text on page 2-12. As requested for Table 3.9-3, it would also be helpful to include a reference to the appropriate map figure on the table pages. Please amend the tables and text as requested. 9. There appears to be no table comparable to "Interim" and "As Constructed" for waste disposal area permanent ditches, and one would appear to be warranted. Figure 2.2-7A "Post-Mining Contours" depicts labeled permanent diversion ditches "C", "F", and "I". It also would appear that ditch segments "D" and "J" will be retained as permanent, but for some reason these ditch segments are not labeled on Figure 2.2-7A. Please provide an appropriate design summary table for refuse area permanent ditches, ensure that all permanent ditches are properly labeled on Figure 2.2-7A, include reference to the map figure on
