Long <br />Division DIreC10r <br />Based on conversations with yourself and Mr. Rod Peck, the landowner representative at the <br />Grassy Gap Mine, the Division proposes to partially approve the band release request at the Grassy <br />Gap Mine. <br />The Division proposes to release 559,271.00 of the $94,271.00 bond leaving a remaining bond <br />amount of 535,000.00. As you are aware, this is 510,000.00 more than the 525,000.00 sum <br />which is to be forfeited by Rockcastle for long-term maintenance. Additionally, it should be <br />understood that the Division does not, by this letter, accept the terms of the Rockcastle proposal <br />dated December 4, 1992. The Division feels Rockcastle and Cross Mountain should come to some <br />agreement regarding payment for 1993 weed spraying. Such agreement should be completed in <br />consultation with the Division. <br />Other remaining issues with regard to bond release appear to be: <br />1. Possible reimbursement to Cross Mountain Ranch for 1992 weed spraying, from Rockcastle <br />Coal Company. <br />2. Evaluation of revegetation in Spring of 1993. <br />3. Future weed spraying initiation procedures and access of monies. <br />The Division will proceed with the partial bond release.
