f <br />EASEMENT DEED AND AGREEMENT <br />THIS EASEMENT DEED AND AGREEMENT is made and entered <br />into as of the ~/~~.day of October, 1979, by and between <br />MARY ANN VIGNA, whose address is P. O. Box 41, Pryor, <br />Colorado (hereinafter referred to as the "GRANTOR"), and <br />RAVENWOOD COAL COMPANY, a Colorado corporation, with <br />mailing address: P. O. Box 4, Aguilar, Colorado 81020 <br />(hereinafter referred to as "RAVENWOOD"): <br />WITNESSETH: <br />For and in consideration of the sum of Ten Dollars <br />($10.00) and other good and valuable consideration, the <br />receipt and adequacy of which is hereby acknowledged by <br />GRANTOR, and in further consideration of the mutual rnve- <br />nants and obligations contained herein, the parties hereto <br />agree as follows: <br />1. Grant of Easement. GRANTOR hereby grants and <br />conveys unto RAVENWOOD an easement and__right-of-way.through, <br />over. and across a strip of land more particularly described <br />as follows: <br />"' The southernmost 300 feet of the SE1/4 <br />of the NW1/4, Section 19, T. 29 S., <br />R. 65 W., Sixth Principal Meridian, <br />together with all rights of access to and egress from this <br />strip of land (the "Property") which may be necessary or <br />incidental to the full and proper use and enjoyment of said <br />easement. <br />2. Annual Rent. RAVENWOOD agrees to pay the GRANTOR <br />the sumo Six Hundred ($600.00) Dollars on the date of <br />execution of this Agreement and on or before each anniver- <br />sary of that date during the term of this Agreement. Pay- <br />ment of this annual rental shall be made by RAVENWOOA mailing <br />a check in the apprapriate amount to the GRANTOR, or person- <br />ally delivering a check in that amount to the GRANTOR, on or <br />before the appropriate date or dates. <br />3. Term and Option to Renew. The term of the grant <br />of the easement described above and the term of this Agree- <br />ment shall be for a period of five (5) years from the date <br />of execution of this Agreement. GRANTOR hereby grants <br />RAVENWOOD an option to renew and extend that term for an <br />dditional five (5) years thereafter by tendering to the <br />;RANTOR a check in the amount of the annual rental stated in <br />~/the preceding paragraph on or before the end of the initial '•" ~` <br />five-year term with a statement that such tender is for the <br />purpose of extending and renewing the primary term for an <br />additional five (5) years. <br />4. Termination. RAVENWOOD may terminate this Agree- <br />ment and the easement granted herein at any time by giving <br />GRANTOR at least thirty i30) days advance written notice of <br />the effective date of said termination. Such notice shall <br />state that RAVENWOOD quitclaims to GRANTOR any and all <br />
