MINING OPERATIONS <br />American Fuels hereby covenants and agrees to conduct <br />its operations in a good and workmanlike manner in <br />order to recover as much of the merchantable coal <br />available in an area located between the coal outcrop <br />line and a point where the overburden reaches an over- <br />all height of eighty (BO) feet, in keeping with good <br />mining practice, and to conduct its operations in such <br />a manner as to prevent the loss of merchantable coal. <br />American Fuels hereby covenants and agrees that it will <br />lay out its workings in the demised premises in a man- <br />ner in keeping with current good mining practices, and <br />further agrees that it will use its best efforts in <br />good faith to comply with instructions as requested by <br />C&U's Director of Subsidiaries pertaining to develop- <br />ment of the surface workings for protection of creeks, <br />highways, ditches, canals, tunnels, railroads and other <br />surface improvements and other matters in accordance <br />with proper and safe mining practice. American Fuels <br />also agrees to pay the aforementioned royalty rate on <br />the computed tonnage coal which has been lost due to <br />improper mining practice on its part. <br />7. TERMINATION <br />a) It is mutually understood and agreed that in the <br />event that American Fuels should discontinue mining <br />operations for a period of six (6) consecutive <br />months, CsU at its option may thereupon cancel this <br />lease upon giving thirty (30) days' written notice <br />thereof to American Fuels by Certified Mail, Return <br />Receipt Requested, addressed to Lessee at the <br />address shown herein, unless said discontinuance of <br />operations by American Fuels be occasioned by <br />strikes, accidents, damage to or destruction of <br />plant, inability of common carrier to make trans- <br />portation, fire, flood, or acts of God or other <br />-7- <br />
