Wcavcr 2 <br />Resolution of the cost estimate for any remaining reclamation liability has been discussed <br />previously during the Division's mid-term review dated February 28, 1995. The Division is <br />willing to allow Energy Fuels to resolve the remaining reclamation liability costs in a mid- <br />term response. <br />Submittal of a map showing the current topography and site conditions in compliance with <br />Rule 2.10.3(j), has been stipulated as a condition for approval for both technical revision <br />Nos. 16 and 18. <br />As has been discussed through telephone conversations, although the Division proposes to <br />approve retention of post-mining structures, reduction of the reclamation liability for these <br />structures must be pursued through the appropriate process as outlined by Rule 3.02.2(4)(d). <br />Until this process occurs the costs for removal of the structures remains included in the <br />reclamation liability estimate. <br />Although the Division concurs with Energy Fuels' decision to rip the former mine parking <br />lot area in lieu of surface material removal prior to seeding this Spring, the Division <br />reminds Energy Fuels that permit conditions commit to testing this surface material for <br />vegetative growth suitability prior to seeding. Review of the Topsoil Substitute Suitability <br />Report submitted to the Division on October 31, 1995 indicates that the former mine office <br />parking area was not sampled. Please sample this area prior to seeding this Spring. As <br />Energy Fuels has committed to as a permit condition, if the Division determines that <br />vegetation is ttnsuccessful in the areas that have not received topsoil, topsoil will need to be <br />imported and re-spread on the former parking lot area. <br />Please contact me if you have additional questions. <br />Sincerely, <br />anet .
