Long <br />Division Director <br />The Division has reviewed Energy Fuels Mining Company's responses to the Division's <br />adequacy concerns identified in our March 21, 1995 letter with regard to Technical Revision <br />No. 17 and proposes to grant partial approval of this revision. Items that Energy Fuels has <br />resolved with this submittal include; confirmation of the length of the Starkville Gulch <br />Permanent Diversion Culvert at 701 feet, and inclusion of a letter from San Isabel Power <br />Company verifying ownership and maintenance of the remaining power lines and poles <br />within the permit area- <br />Items from the Division's March 21, 1995 letter that Energy Fuels has requested be resolved <br />at a later date include; reclassification and retention of the pond light use road and the <br />powder magazine road (Item No. 9), culmination of reclamation estimate costs (Item No. <br />10), and submittal of updated Map 12 and a certified copy of Map 17-] (item No. 11). <br />Upon further review of the Regulations of the Colorado Surface Coal Mining Reclamation <br />Act, Rule 4.03.3(7) does allow for retention of light use roads if it is needed to support the <br />post-mining land use. The Division considers the powder magazine light-use road necessary <br />to support the post-mining land use of rangeland as it provides access to apre-existing ranch <br />road, and proposes to approve its retention. The pond light-use road provides access to the <br />pond and has been requested to remain as permanent. Energy Fuels will need to supply the <br />necessary demonstrations required by Rule 4.05.9 before the Division can determine if the <br />pond may remain as a permanent structure. Until the pond is approved as permanent, the <br />pond light-use road cannot be considered permanent. The Division is unable to approve <br />the pond light-use road as permanent at this time. Please re-submit page 351 to reflect that <br />the pond light-use road is not approved as permanent. <br />
