At the time final reclamation was <br />completed, however, surface ownership of the site had been transferred from BN to the City <br />of 'Trinidad which planned to use the area as a disposal site for treated sewage sludge. As the <br />surface owner, the City of Trinidad leased ponions of the site to x loyal farmer for temporary <br />dryland farming use until the proposed sewage sludge application operations could be initiated. <br />Consequently, grading and seedbed preparation activities were proceeding on leased portions of <br />the site concurrently with the previously described final reclamation efforts and the farming <br />related regrading activities resulted in elimination of the drainage collection sump. <br />EIMC no longer plans to utilize the BN Loadout area, the entire associated surface disturbance <br />area was reclaimed consistent with the approved reclamation plan and landowner's wishes, and <br />the area was returned to a condition consistent with the approved postmining "industrial" land <br />use. Subsequent to «clamation of the site, other activities including the farming activities <br />discussed above, temporary storage of powerline structures by San Tsabcl Power, and <br />redisturbance of a portion of the site as a consequence of adjacent highway construction <br />activities by she Colorado Department of IIighways have effected the configuration, site <br />conditions, and actual use of the site. These activities have apparently been conducted with the <br />consent of the current landowner (City of Trinidad) and their occurrence or any resulting <br />cktanges to the site do not negate the fatt that EPMC did fulfill their reclamation obligation <br />under both the approved permit and applicable regulatory provisions. <br />Given the about noted considerations, 81MC respettfully requests that the OMI,R release that <br />portion of the existing bond for the Raton Creek Mine in the amount of 57,807 which is <br />associated with the IiN Loadout. Upon receipt of notification from the OMLR char rhis <br />submittal meets your requirements for bond relcaze application, EFMC will issue the Proposed <br />Fublic Notice both for publication in the local newspaper per Rule 3.03.2(1) and by certified <br />mail to the individuals or entities identified by the accompanying list. We will also be in <br />contact with your office and the City of Trinidad to schedule and inordinate the pre-release site <br />inspection required by Rule 3.03.2(2). <br />We appreciate your prompt attention and cooperation in [his matter.
