~ iii iiiiiiiiniu iii ~ <br />RECEIVED <br />City of Thornton JAN 1 1 2001 <br />LICENSE AGREEMENT <br />No. 2000-02 Division of Minerals and Geolop~ <br />IN <br />THIS LICENSE AGREEMENT, made this 3~ day of November 2000, between the City of <br />Commerce City, 5291 East 60'" Avenue, Commerce City, COLORADO 80022, a municipal <br />corporation, acting by and through its CITY MANAGER, herein referred to as "City," and the City <br />of Thornton, 9500 Civic Center Drive, Thornton, COLORADO 80229, a municipal corporation, <br />acting by and through its CITY MANAGER, herein referred to as "Licensee" (whether <br />grammatically singular or plural). <br />WITNESSETH That: <br />The term "Licensee" shall include employees, agents and contractors of Licensee. <br />The term "property' as used herein refers to real property, includes easements, rights-of-way <br />and other Ciiy interests in land, and may sometimes be referred to herein as "City property". <br />The City, by these presents, without warranting title or interest, and subject to the covenants <br />hereinafter set forth, does hereby authorize the Licensee, its successors and assigns to: <br />The purpose of the license is: 1) Legal Right to Enter the City East 88'" Avenue right-of-way and, <br />2) placement of a pipeline that will connect two Licensee lined water storage facilities, one <br />located on the south side of East 88'" Avenue and the other on the north side of East 88'" <br />Avenue east on Dahlia Street within the City's jurisdiction at the location described in Exhibit "A", <br />attached hereto and made a part hereof by reference. <br />1. COMPLIANCE WITH RULES, REGULATIONS AND LAWS <br />Any construction and operations initiated under this License shall comply with and conform to all <br />rules, regulations and laws of the City, the South Adams County Fire Protection District, South <br />Adams County Water and Sanitation District and the State of Colorado. <br />2. PLAN REVIEW <br />The Licensee, at least 5 days prior to the proposed date for commencement of the work hereby <br />authorized, shall submit to the City for its approval a duplicate set of final detailed plans of the <br />installation Licensee proposes to construct, utilize, modify, repair, replace or maintain <br />hereunder. No construction will be permitted on the licensed premises until the City has <br />approved the plans therefor. <br />3. NOTICE OF CONSTRUCTION <br />The Licensee shall notify the City's Director of Public Works at least three (3) days prior to <br />commencement of the construction of, modifications or repairs to, Licensee's installation, so that <br />the City may make such inspections as it deems necessary. Such notice shall make reference <br />to the License Agreement number. In the event of emergency repairs required for safety or <br />restoration of service to utility customers, Licensee shall not be required to furnish notice prior to <br />
