~ iii iiiiiiiiniu iii ~ RECEIVED City of Thornton JAN 1 1 2001 LICENSE AGREEMENT No. 2000-02 Division of Minerals and Geolop~ IN THIS LICENSE AGREEMENT, made this 3~ day of November 2000, between the City of Commerce City, 5291 East 60'" Avenue, Commerce City, COLORADO 80022, a municipal corporation, acting by and through its CITY MANAGER, herein referred to as "City," and the City of Thornton, 9500 Civic Center Drive, Thornton, COLORADO 80229, a municipal corporation, acting by and through its CITY MANAGER, herein referred to as "Licensee" (whether grammatically singular or plural). WITNESSETH That: The term "Licensee" shall include employees, agents and contractors of Licensee. The term "property' as used herein refers to real property, includes easements, rights-of-way and other Ciiy interests in land, and may sometimes be referred to herein as "City property". The City, by these presents, without warranting title or interest, and subject to the covenants hereinafter set forth, does hereby authorize the Licensee, its successors and assigns to: The purpose of the license is: 1) Legal Right to Enter the City East 88'" Avenue right-of-way and, 2) placement of a pipeline that will connect two Licensee lined water storage facilities, one located on the south side of East 88'" Avenue and the other on the north side of East 88'" Avenue east on Dahlia Street within the City's jurisdiction at the location described in Exhibit "A", attached hereto and made a part hereof by reference. 1. COMPLIANCE WITH RULES, REGULATIONS AND LAWS Any construction and operations initiated under this License shall comply with and conform to all rules, regulations and laws of the City, the South Adams County Fire Protection District, South Adams County Water and Sanitation District and the State of Colorado. 2. PLAN REVIEW The Licensee, at least 5 days prior to the proposed date for commencement of the work hereby authorized, shall submit to the City for its approval a duplicate set of final detailed plans of the installation Licensee proposes to construct, utilize, modify, repair, replace or maintain hereunder. No construction will be permitted on the licensed premises until the City has approved the plans therefor. 3. NOTICE OF CONSTRUCTION The Licensee shall notify the City's Director of Public Works at least three (3) days prior to commencement of the construction of, modifications or repairs to, Licensee's installation, so that the City may make such inspections as it deems necessary. Such notice shall make reference to the License Agreement number. In the event of emergency repairs required for safety or restoration of service to utility customers, Licensee shall not be required to furnish notice prior to
