4 <br />Section V- Variances to the Permit <br />Rules 2.06.2, 2.06.3, 2.06.5 and 2.06.7 require that experimental practices, mountaintop <br />removal variances, variances from approximate original contour (AOC), and variances from <br />contemporaneous reclamation, respectively, be reviewed by the Division where applicable <br />during the Midterm Review. The Eagle S & 9 Mine does not have a variance from <br />mountain top removal or AOC. <br />A variance from contemporaneous reclamation was granted for Williams Fork Strip Mine <br />No. 2 in order for it to serve as an entrance for a second set of portals into the Eagle No. <br />9 Mine. In Mazch of 1985, the operator ceased mining of the Eagle 1`l0. 9 Mine. During <br />the permit revision process of 1987, the Division placed a stipulation on the permit that <br />required the operator to commence reclaiming the Williams Fork Strip Pit. The entire <br />Williams Fork Strip Mine No. 2 was reclaimed by October 15, 1987. <br />Section VI- Decision to Require Revision <br />The following itetns pertain to various portions of the Eagle 5 & 9 min<; permit which need <br />to be revised and/or need to reflect the current status and condition of the site. Cyprus <br />Empire Corporation should submit a technical revision to the permit to address all of the <br />items below no later than May 1, 1996. <br />1. Please update the identification of interest portion of the permit as required under <br />2.03.4. <br />2. Page 2.04-5 9A to 9C (Table 3A part 1, 2 and 3) depicts a surnmary of all current <br />hydrologic monitoring stations. These pages appear to be in conflict with Exhibit 29, <br />Table 1. Please revise the permit pages to reflect the current monitoring stations at <br />the Eagle 5 & 9 Mine. <br />3. Page 2.04.7-73R and 2.04.7-73Ra states that sampling of the Yampa River stations <br />was discontinued in 1985. Under TR-26, alluvial wells YAW-951, YAW-952 and <br />surface monitoring site Y-3 were reactivated with the extension of the north mains. <br />Please update this portion of the permit pages to reflect reactivating the monitoring <br />locations noted above. <br />4. It appears that a new trailer has been added to the Mine 5 facility area. Please <br />include this office trailer on the facilities map (Map 25) and describe it in the permit <br />text. <br />5. The Division was unable to locate a certified plan for Pond 9-Pl in the permit. <br />Please provide the Division with a copy of this map, or direct t~s to where it may be <br />located in the permit. <br />
