Box 591 Michael B. long <br />Somerset, CO 81434 oiv isfon oheanr <br />RE: Ninor Revision No. 150; We8t Elk Nine; Permit No. C-80-007 <br />Dear Ms. Welt; <br />The Division has reviewed the information submitted by Mountain <br />Coal Company (MCC) dated May 26, 1995, June 2, 1995, July 5, 1995, <br />and July 19, 1995 regarding the above referenced minor revision <br />which proposes to revise the drainage control plan and the small <br />area exemption demonstration for the Lone Pine fan. The Division <br />has some adequacy concerns regarding the aforementioned submittals. <br />This letter is separated into three sections: the Division's May <br />10 letter, the Division's May 15 letter, and adequacy concerns that <br />have not been addressed in either letter but are a result of the <br />most recent submittal by MCC. <br />Mav 10 Letter <br />5. Revised Map 54A, dated July 19, 1995, should be further <br />revised to show the contours to the southwest and southeast of <br />the underground development waste pile to show the location <br />where D-1 breaks across the road above the pile. The map <br />should also be revised to include ditch and culvert labels as <br />designated on Enclosure 1. <br />6. The revised page two, submitted on May 26, 1995, is <br />acceptable. <br />May 15 Letter <br />The Division appreciates MCC's affirmation of agreement with the <br />Division regarding the purpose of the SEDCAD demonstration and the <br />importance of the alternative sediment control measures, silt <br />fence, hay bales, etc. However, as requested in the Division's May <br />15, 1995 letter the demonstration should be revised to add the <br />statement included in the original demonstration, "Best management <br />practices of ditch feather distribution and silt fences or straw <br />
