COMMENT: As previously discussed in the response to Rule 2.08.4, <br />there is no change in postmining land use plans. <br />• Rule 4.09.1(9) The final configuration of the fill shall be designed <br />to minimize erosion. Terraces may be utilized to control erosion and <br />enhance stability if approved by the Division and consistent with <br />4.14.2(2). <br />COhAiENT: The final design will require one continuous slope. The <br />advantages for minimizing moisture effect on the placed material <br />should outweigh the erosion concerns for design. The final reclamation <br />configuration will include a design for diverting as much of the water <br />around the bench area as possible. For the drainage which occurs on <br />the bench area, drainage areas with proper riprap will be designed to <br />minimize erosion. Those details are included in Appendix 1-B. <br />Rule 4.09.1(10) <br />Where the slope in the disposal area exceeds <br />1v:2.Bh (36 percent), or such lesser slope as .may be <br />designated by the Division based on local conditions, keyway <br />cuts (excavations to stable bedrock) or rock toe buttresses <br />• shall be constructed to stabilize the fill. Where the toe <br />of the spoil rests on a downslope, stability analyses shall <br />be performed in accordance with 2.05.3(6)(b), (c) and (d) <br />[o determine the size of the rock toe buttresses and <br />keyway cuts. <br />COMMENT: Appendix 1-A demonstrates that slopes will be less than <br />36 percent. However, toe stabilization has been carefully designed. <br />Refer to Appendix 1-B for details. <br />Rule 4.09.1(11) <br />The fill shall be inspected for stability by a <br />registered engineer or other qualified professional <br />specialist experienced in construction of earth and rockfill <br />embankments at least quarterly throughout the construction <br />and during the fallowing critical construction periods: <br />(1) removal of all organic material and topsoil, <br />(2) placement of underdrainage systems, (3) installation <br />of surface drainage systems, (4) placement and compaction <br />of fill materials, and (5) revegetation. The registered <br />engineer or other qualified professional specialist shall <br />provide to the Division a certified report within 2 weeks <br />after each inspection that [he fill has been constructed <br />as specified in the design approved by Che Division. A copy <br />• of the report shall be retained at the minesite. <br />-8- <br />
