RECOMMENDED MODIFICATIONS TO THE TURNPIKE AND DEEPE <br /> ' PIT RECLAMATION PLANS <br /> The recommended modifications to the Deepe Pit and the Turnpike Pit Reclamation Plans <br /> are generally based upon the assumption that proposed variances should not extend <br /> ' beyond the obligations of the mining agreements between the seller and its lessees and the <br /> requirements of mining permits. The following two reclamation plans were used as the <br /> ' basis for our comments: <br /> Reclamation Plan - Deepe Pit - Boulder, CO dated 1/26/96 (stamped Preliminary) <br /> Turnpike Reclamation Plan - Boulder, CO dated 4/15/96 and approved by the <br /> Colorado Division of Minerals and Geology on 4//30/96 <br /> Exhibit IX-1, Composite Reclamation Plan for the Deepe Pit and the Turnpike Pit, is a <br /> composite drawing of the above named reclamation plans combined into a single drawing <br /> which provides a visual representation of the overall Flatiron Property Reclamation Plan <br /> proposed by the owners and operators of the mining facility. <br /> 1 <br /> 1 The following description of recommendations as shown on Exhibit IX-2, Recommended <br /> Modifications to the Deepe Pit and Turnpike Pit Reclamation Plans, should be considered <br /> prior to preparation of the final reclamation plans for the Flatiron Property. The current <br /> regulatory floodplain is based upon the assumption that the site perimeter berm is certified <br /> by FEMA as a flood protection levee. It is important that this berm be strengthened and <br /> elevated as required in order to be certified by FEMA. <br /> We recommend that the acreages in the south and southeastern portion of the property, <br /> outside of the site perimeter berm, be utilized for environmental enhancement, floodplain <br /> storage, open space and potentially a wetland bank. Open water is not recommended for <br /> ' this zone in order to more prudently utilize the available water rights for irrigation rather <br /> than for lake evaporation. This proposed modification will require the pond(s) at the <br /> -26- <br />
