Mr. Carl Mount • MASSEY SEMEN~F SCHWARZ & BAILEY, P. C.
February 6, 2002
Page 2
would form the best basis for the TR. I will ensure that the requisite TR
processing fee is included with that submittal.
As I also mentioned to you during our telephone conversation, MPC has
filed Flood Plain Use Permit applications with Adams County and Commerce
Ciry, at the request of those entities, and as they believe is necessary for the
work proposed in the Revised Drainage Control Plan. That stated, it appears
that both the County and the City will be looking to UDFCD to "bless" the
construction drawings I mentioned above as the basis for their issuing their
respective approvals.
MPC has also filed a Section 404 permit amendment application with the
U.S. Army Corps of Engineers to ensure that the current permit is updated to
authorize the work in the Plan and to resolve an ongoing Corps enforcement
action. We continue to believe, based on the representations of the Corps, the
City, and that County, that the approvals will timely issue as necessary to allow
the company to meet the deadline specified in Section 2.b of the Board's Order.
Should you have any questions regarding the status of Task Force
process, or the approvals mentioned immediately above, please do not hesitate
to call me.
Thank you.
Sincerely yours,
`~ 11
Jeffrey W.
