This issue <br />is extremely important to Grand County and we believe <br />it is imperative that the company complies with all <br />applicable rule, regulations and standards applicable to <br />the landfills and the memorandum of understanding <br />between the Division of Minerals and Geology and the <br />CDPHE. <br />® Technical Revision TR-12 was approved in January 2003_ <br />This included approval for disposal of inert debris <br />generated during demolition of buildings and structures <br />:r at the time of reclamation. The Division of Minerals and <br />Geology coordinated this approval with the CDPHE <br />Division of Hazardous Materials and Waste Management <br />as required through their memorandum of <br />understanding. The landfill sites were recently inspected <br />and were found to be properly managed and monitored <br />as required. The Division of Minerals and Geology is <br />available to discuss landfill issues with Grand County <br />stafF and commissioners in a venue separate from AM- <br />04 pre-hearing conference. <br />The pre-hearing conference being conducted will describe the Division of Mineral and <br />Geology's review process, eRplain the rights and responsibilities of the parties, discuss <br />and resolve issues to the extent possible, describe the Colorado Mined Land <br />Reclamation Board (the "Board") Hearing processes, determine the issues under the <br />Board's jurisdiction and determine who has demonstrated standing to be a party to the <br />Formal Board Hearing. Any decisions reached in the pre-conference are not final until <br />adopted by the Board of a Formal Hearing. As a resulf of Phis pre-conference apre- <br />hearing order will be prepared and mailed to all parties within 10 days and will include <br />a list of the parties; a recommended list of issues to be considered by the Board of the <br />formal hearing; and a schedule for the hearing. An outcome of the pre-hearing <br />conference will result in the Board of County Commissioners determining if a formal <br />Board Hearing on this matter will be required. A formal hearing may also be set if the <br />Board rejects the pre-hearing order. It is the purpose of the pre-conference to resolve <br />remaining issues.
