AUG-29-2003 FRI 09; D4 AM B B EXCAVATING <br />(50 Stat. 564, 595, as decreed <br />Nos. 2782 ,5016, and 5017) United <br />Colorado; and the Operating <br />(hereinafter referred to as the <br />Federal Register on December 22, <br />1984, and as amended Septe <br />FAX N0. 9709262344 <br />in the Consolidated Cases (Civil Action <br />States District Court for the District of <br />Policy for Green Mountain Reservoir <br />"Operating Policy") as published in the <br />1983, which became effective January 23, <br />tuber 3, 1987, as published in the <br />F ral Resister on September 11, 1987. The Reservoir was authorized to <br />provide replacement water for senior downstream diversion rights in western <br />Colorado when water is diverted to or stored for use in eastern Colorado <br />through the CBT project. Additional capacity was provided for hydroelectric <br />power generation and beneficial uses in western Colorado including <br />irrigation, municipal/domestic, and industrial uses. In accordance with <br />the Operating Policy, b6,000 acre-feet of water annually is deemed adequate <br />to satisfy irrigation and domestic uses perfected by use prior to <br />October ib, 1977. The remaining 28,800 acre-feet of capacity (34,000 acre- <br />feet less 5,200 acre-feet dead storage) is available for beneficial use by <br />West Slope water user contractors and has been determined to be available <br />to develop the Reservoir's annual marketable yield. <br />b. The Contractor desires to contract with the United States, pur- <br />suant to Federal Reclamation laws and the laws of the State of Colorado, <br />for water service from Green Mountain Reservoir. <br />c. The United States desires to provide such water service from <br />the marketable yield of Green Mountain Reservoir in accordance with <br />5.
