At any time the marketable yield is <br />determined to be less than the total amount of water under contract, any <br />resulting shortages shall be apportioned pursuant to Article 7. <br />WATER SERVICES CHAR E5 <br />p. a. In accordance with paragraph 5 of the Operating Policy, the <br />United States will charge its Contractors differential Yates for irriga- <br />tion, municipal/domestic, and industrial water service. These rates <br />include an appropriate share of the Reservoir's actual annual OMSR costs. <br />The rates shall be adjustable by the United States to cover OM&R costs if <br />such costs exceed the rates set forth herein. <br />b. The charge for irrigation water service will be an annual <br />charge of E6 per acre-foot for the amount of water contracted for herein, <br />and which the United States is capable of delivering to the Contractor. <br />Payment of this charge shall be due on July 1 for water to be delivered <br />during the succeeding year. No water shall be delivered prior to paymettt. <br />Whether or not the Contractor requests or takes delivery pursuant to <br />Article 5, the Contractor is required to pay annually the charge far all <br />of the irrigation water contracted for herein; Provided, That the <br />United States is Capable of delivering said water. <br />P. 12 <br />9 <br />
