The Contractor hereby contracts for 37 acre-feet of water <br />service annually from the Reservoir as follows: <br />(1) ,acre-feet of water for irrigation use. <br />(2) ~ acre-feet of water for municipal/domestic use. <br />(3) ~ acre-feet of water for Category A industrial use. <br />The United States agrees to provide such water service subject to the terms <br />and conditions of this contract. The United States shall not enter into <br />any contract that will result in the total amount of water marketed from <br />the Reservoir exceeding the marketable yield in effect at that time; <br />ro That the United States reserves the right to make short-term <br />sales of water from the Reservoir as long as such sales do not impinge upon <br />the Contractor's entitlement to take delivery of the water contracted for <br />herein. There shall be no right t0 carryover storage of undelivered water <br />contracted for herein from year to year. <br />b. The 20,000 acre-foot marketable yield of the Reservoir is based <br />on the assumptions and conditions incorporated in the supporting hydrology <br />studies documented in the report entitled, "Green Mountain Water Saies <br />Hydrology," dated September 15, 1988. The marketable yield may vary <br />depending on changes in future operating Condittons.
