<br /> <br /> <br />(2) Grading will be done in a manner to combat erosion and <br />siltation of the affiected lands. The rock rubble (caprock) on <br />or near the surface will be a major tactor in deterring any ~ <br />erosion. The plan will protect areas outside the affected L~' <br />lands from slides or other damage. The rock high walls will <br />be stabilized. <br />(3) Backfilling and backsloping will follow mining as <br />closely as is consistent with product stockpiling and equip- <br />ment movement. <br />(4) There will be no refuse, acid-forming or toxic producing <br />materials to be mined or disposed of. The only materials in- <br />volved will be the clay body, caprock, overburden and <br />topsoil, which are chemically inert. <br />(5) There will be no drill or auger holes that will be a <br />part of the mining operation that would require plugging. <br />There will be no adits or shafts to be sealed, since this is <br />an open pit operation. <br />• (6) Backslopes will be finishetl,at 4H:1V or flatte , which <br />will be compatible with configuration of surround-ing land <br />forms. This dry pit operation will not involve-ariy lakes or <br />ponds. The highwall at the pit face will be stabilized.'~„r <br />(7) The operator and Landowner/Lessor's choice of reclama- <br />tion is rangeland. The reclaimed area can be traversed by <br />farm machinery, but this is not essential to the final use. <br />6.2 Water <br />(1) Hydrology and water quality <br />This dry pit operation will have no efifiect on water rights or <br />hydrology of the area. The operation is designed to retain <br />historic drainage patterns. <br />(a) The operator has obtained a Brick Institute of °~ ~ <br />- .~ ., <br />America Group Stormwater Permit - ID # 1024. This is /~'"' <br />the only known applicable Colorado water law that ~~~cx/1J"~_'u"B"~ <br />would apply to this operation. ~,„.»^~-~~~`• <br />v ~_ <br />(b) This dry pit operation will be in compliance with all <br />presently known applicable federal and Colorado water <br />quality laws and regulations, since no water or <br />• water rights are involved. <br />(c) There will be no dredge and fill activities involved <br />with this operation to come under the purview of <br />Colorado and federal requirements. <br />(d) There will be no temporary or large siltation <br />structures to require removal from drainways. <br />
