<br />4. Pages in Appendices 4.6-N and 4.6-0 should be numbered on every page, consistent <br />with the currently approved permit application package. <br />5. The reclamation performance bond for the Center and West Ridge Ponds will not be <br />released until vegetation on the embankments and slopes meets all applicable success <br />standards. Observations over the past summer indicate that the vegetation currently <br />established on the pond embankments may not meet bond release requirements. The <br />Center Ridge Pond embanlanents and sideslopes should be seeded with the currently <br />approved permanent seed mix. Vegetative cover will be deemed successful when at or <br />above 47%, as stated on page 4.4-4 of the approved permit application. The West <br />Ridge Pond embankments and sideslopes also should be seeded with the currently <br />approved permanent seed mix. Revegetation of the West Ridge Pond azea will be <br />deemed successful when it meets the permanent program criteria outlined in Section <br />4.4.2.1 of the permit application package. <br />Your application also included a request to declassify the alluvial valley floor (AVF) status of <br />Oak Creek. Your justification for declassification is based lazgely on a statement contained in <br />the OSM publication Alluvial Valley Floor Identification and Study Guidelines. While the <br />publication is helpful in identifying the requirements for the designation of an alluvial valley <br />floor, the requirements of the Rules and Regulations of the Colorado Mined Land Reclamation <br />Boazd need to be specifically addressed. Rule 2.06.8 addresses operations on alluvial valley <br />floors. To consider declassification of Oak Creek, designated an alluvial valley floor in the <br />initial permitting process, the Division is in need of additional information. <br />6. Rule 2.06.8(3)(b)(i) requires "Mapping of unconsolidated streamlaid deposits holding <br />streams including, but not limited to, geologic maps of unconsolidated deposits, maps <br />of streams..., topography showing local and regional terrace levels, and topography of <br />terraces, flood plains and channels showing surface drainage patterns." Please provide <br />a map on a scale of 1"=100' showing the above listed features of Oak Creek in the azea <br />for which declassification is proposed. The mapped azeas should include lands 200' <br />north and south beyond the area. Please include the depth and aerial extent of all <br />deposits, including coal fines and refuse deposits from previous mining disturbances. <br />7. Rule 2.06.8(3)(b)(ii) requires "Mapping of all lands that are currently or were <br />historically flood imgated, showing the location of each diversion structure, ditch, dam <br />and related reservoir,u•rigated land, and topography of those lands:' Map 4.6-16, <br />"Imgation Ditches and Irrigated Lands" was submitted in the original application. <br />Please advise us of the accuracy of that map. If additional structures have been <br />constructed or land use changes have occurred, please provide a map on a scale of <br />1"=100' which shows those features listed.
