Long <br />Division Director <br />Subject: Technical Adequacy, Technical Revision 50, Permit C-81-019 <br />Dear Mr. Kiger: <br />This application includes an important reconciliation of the status of wells and drill holes, and <br />represents a significant effort on the part of Colowyo Coal Company L.P. staff. An adequacy <br />review of the Technical Revision 50 (TR-50) application has been completed by the Division of <br />Minerals and Geology (Division), from which the following questions and guidance have been <br />derived. <br />Item 1. Information provided in the application identified 13 monitoring wells permitted with the <br />Office of the State Engineer, Colorado Division of Water Resources (CDWR). If these wells <br />(holes) were drilled for the purposes of coal exploration or coal development, they also fall under <br />the provisions of the Colorado Surface Coal Mining Reclamation Act. Please inform the Division <br />whether these 13 wells were drilled for the purposes of coal exploration or coal development. <br />If these wells were drilled for the purposes of coal exploration or development, then the <br />reclamation of these 13 wells/coal exploration or development holes needs to be described and <br />bonded for, even if they are permitted by CDWR. The Division finds no duplication of (State) <br />bonding requirements (none is required by the CD WR). Such bonding can be released (in this <br />case, not bonded) if the wells aze transferred under the provisions of Rule 4.05.14. In the event <br />these 13 wells holes were drilled for the purposes of coal exploration or development holes, <br />please include them in a revision to one of your exploration Notice of Intents (NOIs) or a new <br />NOI application. In such event, please include costs of reclamation (the holes and associated <br />disturbances) for bonding under the provisions of Rule 2.02. In the event that the drilling of <br />these 13 holes was not associated with coal exploration or development, pease add them to <br />the Drawing "Well Locations" dated 12-10-96 of your Permit C-81-019 under the <br />requirements of Rule 2.04.7(4). <br />Item 2. The TR-50 application proposes the transfer of exploration holes within the permit <br />boundary to NOI-X-95-109-05. Please submit a revision to one of your NOI(s) (or a new <br />application if more appropriate) to be processed concurrently with, and as a prerequisite to <br />approval of, Technical Revision 50 to the Permit. The NOI revision or new application needs to <br />be complete with regard to requirements of Rule 2.02. Your concurrent application for complete <br />bond release of NOI bonds may be processed following inclusion of all exploration holes <br />identified in the TR-50 application. <br />
